Terms and conditions

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using the https://nestpregnancyandparenting.co.nz website (the “Service”) operated by Nest Pregnancy and Parenting (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of New Zealand without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Nest Pregnancy and Parenting and its licensors.

Refunds

A minimum of four weeks notice is required if you wish to withdraw from any of our group workshops or classes. Written cancellation requests received more than 4 weeks before the first class commences will receive a full refund, minus a $25 administration fee. If less than four weeks’ notice is given, no refund will be issued.

Transfers

You can transfer to another course or workshop free of charge, providing there are spaces available and the request is received in writing more than 4 weeks before the original course commences.

TENS machine hire

  1. The TENS machine will only be used by the person named on the hire form.
  2. The Hirer will have discussed and sought approval from their medical practitioner before using the TENS machine.
  3. The Hirer will follow the instructions as provided.
  4. The success of using a TENS machine is labour cannot be guaranteed.
  5. A fully refundable bond of $60 is payable to secure the booking. The bond is returned to the customer within 10 working days once the TENS machine is returned in good working order.
  6. Failure to return the TENS by the due date will result in the Hirer being charged $10 for each and every week, or any part of a week, over and above the hire period until the TENS is returned.
  7. If the unit is not returned for any reason the Hirer will be charged for that unit ($205).
  8. If the unit is returned incomplete or any items are damaged, the Hirer will be charged accordingly for the missing or damaged item/s as follows: $205 for the TENS machine, $70 for a carbon rubber electrode (if supplied, depends on model provided), $20 for a cable, $10 for a container, $5 for an Instruction Booklet, $5 for a lanyard, and $5 for a Tac Gel bottle (if supplied, depends on model provided.)
  9. Equipment must be returned in clean condition otherwise a $10 cleaning fee will apply.
  10. The TENS unit must be returned in the packaging provided to protect the unit.
  11. In the event of damage to, or loss of the TENS by the Hirer, the full retail value ($205) is payable to Nest Pregnancy and Parenting Education Limited by the Hirer.
  12. TENS machines are fully tested prior to dispatch. However, the liability of Nest Pregnancy and Parenting Education Limited shall not exceed the rental charge.
  13. The Hirer should check the contents of the hire pack upon receipt and familiarise themself with the TENS and the instructions. The Hirer must advise Nest Pregnancy and Parenting Education Limited of any problems whatsoever immediately. Nest Pregnancy and Parenting Education Limited accepts no responsibility where the Hirer fails to do so and renders it impossible for Nest Pregnancy and Parenting Education Limited to take any corrective action.
  14. Nest Pregnancy and Parenting Education Limited is not accountable for any injury or damage sustained as a result of misuse.
  15. In the event of a hire cancellation PRIOR to the TENS being dispatched you will be refunded the full amount minus an administration fee of $15.
  16. In the event of a hire cancellation AFTER the TENS has been dispatched NO REFUND can be made.
  17. No refund is given if the products are unused, unclaimed, or otherwise.
  18. The TENS hire period is for a full 6 weeks.  Should you return your TENS machine early we are not able to offer part refunds of the hire fee.
  19. Orders are posted (or hand-delivered locally) on Thursdays and Sundays each week. We require at least one day’s notice to prepare your order. Short notice orders must therefore be received by 12 noon on Wednesday/Saturday to be dispatched on Thursday/Sunday (as applicable), otherwise they will go out on the following dispatch day. Once the unit has been dispatched no refund is available if the unit does not arrive in time for the birth.  We are based in Birkdale, Auckand; pickups can be arranged if you are local and need the TENS machine urgently.
  20. We aim to dispatch postal orders 5 working days prior to the hire start date. A third party is used for postal deliveries and therefore Nest Pregnancy and Parenting Education Ltd cannot guarantee a delivery date or timeframe. Once the unit has been dispatched no refund is available if the unit does not arrive in time for the birth. 
  21. If a Customer orders a TENS unit during COVID lockdowns, shipping delays are to be expected and shipping times cannot be guaranteed. Once the unit has been dispatched no refund is available if the unit does not arrive in time for the birth. 
  22. If the unit has not arrived when expected, it is the Customer’s responsibility to contact Nest Pregnancy and Parenting Education Ltd to assist with tracking the item. Nest Pregnancy and Parenting Education Ltd cannot be held responsible if they are unaware that a unit has not arrived by the expected date.
  23. In providing Nest Pregnancy and Parenting Education Limited with personal contact details and payment, the Hirer agrees to the above terms and conditions.

Our Service may contain links to third-party websites or services that are not owned or controlled by Nest Pregnancy and Parenting. Nest Pregnancy and Parenting has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Nest Pregnancy and Parenting shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
